Terms and Conditions

1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Promotion commences at 9:00 am AEST in NSW on Tuesday, 14/07/2024 and ends at 05:00pm AEST in NSW on Monday 30/09/2024 ("Promotional Period").
3. The Promotion is open to residents of NSW (and other states where the law allows residents to enter promotions of this nature) who are account holders of designated Perpetual Investment Funds and have been invited by the Promoter to enter ("Eligible Entrants"). Employees of the Promoter that are associated with this Promotion and their immediate families are ineligible to enter. Entry into the Promotion is free.
4. To enter, an Eligible Entrant must, during the Promotional Period, complete the provided form and return to Perpetual via the provided address or contact our contact centre and quote “update your details campaign”.
5. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including on Eligible Entrant's identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Incomplete entries will be deemed invalid.
7. Entry is free of charge.
8. Only one (1) entry is permitted per Eligible Entrant.
9. This is a game of chance and skill plays no part in determining the winner.
10. If there is a dispute as to the identity of an Eligible Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant.
11. The winners of the prizes will be drawn at random, and the draw will take place at the Promoter's office at level 18, 123 Pitt Street Sydney NSW 2000 Thursday 17 October 2024. The winners will be notified in writing or by phone within five (5) business days of the draw.
12. The Promoter's decision is final and no correspondence will be entered into.

Prize

13. The first four (4) valid entries drawn of Eligible Entrants will each win one (1) $500 eftpos gift card.
14. Total prize pool value is $2,000.
15. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. The prize is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

General

17. The Promoter reserves the right to publish the name of the competition winners unless a winner advises the Promoter not to disclose their identity at the time they entered the Promotion.
18. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
19. The Promoter and its associated companies (including their respective officers, employees and agents) assume no responsibility for any error, omission, interruption, deletion, defect, delay, or communications line failure in the operation of its own or any other organisation's website, email or telecommunications systems; or in relation to the theft, destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be legally available.
20. Any cost associated with accessing the promotional website and participating in the Promotion, is the Eligible Entrant's responsibility.
21. Except for any liability that cannot by law be excluded or limited, the Promoter and its associated companies (including their respective officers, employees and agents) exclude all liability (including negligence) arising in any way out of or in connection with: (a) any technical difficulties or equipment malfunction impacting the Promotion or participation in the Promotion; (b) any theft of, unauthorised access to or third party interference with any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any tax liability incurred by a winner or Eligible Entrant; or (d) how any winner or other person may use or not use the prize.
22. No party, including the Promoter and its associated companies (including their respective officers, employees and agents), will be liable for any indirect, special or consequential loss, whether arising under contract, tort (including negligence), statute, equity or otherwise, arising out of or in connection with the Promotion.
23. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities, and in accordance with applicable privacy laws. Entry is conditional on providing this personal information. The Promoter may, for a period no longer than two (2) years following the final closing date of the competition, unless instructed otherwise by an entrant, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out of this, and any request to access, update or correct their personal information, to the Promoter. All entries become the property of the Promoter.
24. The Promoter will arrange delivery of the prizes to each winner by registered post to the winner's nominated address within ten (10) days of the winner being notified. The Promoter reserves the right to request that proof of identity such as valid photographic ID e.g. a driver licence is provided by the prize winner before the prize is mailed to them. The winner will be asked to confirm their preferred mailing address for the purposes of receiving the prize. Alternatively, the winner may elect to collect the prize from the Promoter at level 18, 123 Pitt Street, Sydney NSW 2000.
25. If a winner fails to nominate an address in order to receive their prize within ten (10) business days of being notified or by 5pm AEST Wednesday 30 October 2024, then the prize will be deemed to be forfeited. The Promoter reserves the rights to conduct a second chance draw to distribute the unclaimed or forfeited prize.
